This data protection declaration clarifies the type, scope and purpose of the processing of personal data (hereinafter referred to as “data”) within our online offering and the associated websites, functions and content as well as external online presences, such as our social media profile. “personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, online identifier (e.g. a cookie) or to one or more specific characteristics which express the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person, is regarded as identifiable.<\/p>\n\n\n\n

“processing” means any operation carried out with or without the aid of automated processes, or set of operations, relating to personal data. The term is broad and covers practically every handling of data.<\/p>\n\n\n\n

The “controller” is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data.<\/p>\n\n\n\n

Applicable legal bases<\/h2>\n\n\n\n

In accordance with Art. 13 GDPR we inform you regarding the legal basis of our data processing. If the legal basis is not mentioned in the data protection declaration, the following applies: The legal basis for obtaining consent is Art. 6 para. 1 lit. a and Art. 7 GDPR, the legal basis for processing in order to fulfil our services and carry out contractual measures as well as answer inquiries is Art. 6 para. 1 lit. b GDPR, the legal basis for processing in order to fulfil our legal obligations is Art. 6 para. 1 lit. c GDPR, and the legal basis for processing in order to safeguard our legitimate interests is Art. 6 para. 1 lit. f GDPR. In the event that vital interests of the data subject or another natural person make processing of personal data necessary, Art. 6 para. 1 lit. d GDPR serves as the legal basis.<\/p>\n\n\n\n

Cooperation with processors and third parties<\/strong><\/h2>\n\n\n\n

Insofar as we disclose data to other persons and companies (contract processors or third parties) within the scope of our processing, transfer them to them or otherwise grant them access to the data, this shall only take place on the basis of legal permission (e.g. if a transfer of the data to third parties, such as payment service providers, pursuant to Art. 6 Para. 1 lit. b GDPR is necessary for the performance of the contract), if you have consented to this, if a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).<\/p>\n\n\n\n

If we commission third parties with the processing of data on the basis of a so-called “order processing contract”, this is done on the basis of Art. 28 GDPR.<\/p>\n\n\n\n

Content Delivery Network BunnyCDN<\/h2>\n\n\n\n

We would like to inform you that we use BunnyCDN’s Content Delivery Network (CDN) to improve the loading times of this website. BunnyCDN makes our static files such as images and script files available via their network. All personal data is anonymized and not passed on to third parties. In such cases, it cannot be ruled out that authorities in the third country may gain access to the data and that the enforcement of your data subject rights may be limited.<\/p>\n\n\n\n

          The transfer will only take place if the requirements of Art. 44 et seq. of the GDPR are met. This means, in particular, that appropriate safeguards are in place, such as the conclusion of standard contractual clauses.<\/p>\n\n\n\n

                      To the extent that the material contains rights under copyright law or other rights (e.g., personality rights, including the right to one\u2019s own image) (hereinafter referred to as “Rights”<\/strong>), I grant Musicboard the necessary Rights in a simple, unlimited manner in terms of time, location, and content, and with the right to sublicense, so that Musicboard can use the material for press and public relations work and marketing purposes for the F\u00eate de la Musique Berlin 2026, both online on the festival\u2019s website and in its app.<\/p>\n\n\n\n

                      My grant of Rights includes, in particular, the right to reproduce, distribute, make publicly accessible, and transmit the material. It also includes the right to edit the material. My grant of Rights further covers the rights of third parties, insofar as these have been used or created in the material. In particular, I ensure that I have obtained the Rights (and the consent of the performing artists in accordance with the Copyright Act for Works of Visual Arts) for the aforementioned purposes and to the aforementioned extent from all parties involved in or depicted in the material (e.g., performing artists), and I also ensure that I have obtained from the performing artists the right to further grant such Rights to Musicboard (right of sublicense).<\/p>\n\n\n\n

                      I guarantee that I am the holder of all Rights necessary for the use of the uploaded material and that all Rights granted under this agreement are freely transferable, can be granted, and do not infringe any third-party rights. This includes, in particular, copyrights, related rights, and other rights, including personality rights (such as the right to one\u2019s own image) as well as trademark and title rights.<\/p>\n\n\n\n

                      I further guarantee that the use of the material does not infringe any third-party rights.<\/p>\n\n\n\n

                      With reference to the aforementioned guarantee, I indemnify Musicboard against all claims by third parties resulting from the use of the granted Rights.<\/p>\n\n\n\n
